Eligibility
To be eligible to sell through Buy Your Watch, sellers must:
- Be at least 18 years of age.
- Legally own the watch(es) they intend to sell.
- Provide accurate and truthful information about the condition and authenticity of their watch(es).
Selling Process:
- Valuation: Sellers must submit a valuation request through our website, including detailed information and photographs of their watch(es).
- Offers: We will provide a valuation based on the information provided. Acceptance of our offer will constitute an agreement to sell your watch to us at the offered price.
- Inspection: Upon agreement, sellers must send their watch(es) to us for inspection. We reserve the right to adjust the offer based on the physical inspection.
- Payment: Once the final offer is accepted, payment will be made to the seller via their preferred payment method within a specified timeframe.
Responsibilities of Sellers:
- Ensure all information provided about the watch(es) is accurate and complete.
- Comply with all applicable laws and regulations regarding the sale of goods.
- Be responsible for the cost and safety of shipping the watch(es) to us, unless otherwise agreed.
Intellectual Property:
- Sellers grant buyyourwatch.com.au a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish, translate, and distribute content provided by the seller (including but not limited to photos and descriptions of the watch) in any existing or future media.
Pawning Watches and Lending Money
Loan Terms and Conditions:
- Loan Amount: The loan amount is determined based on the assessed value of the watch.
- Interest Rate: We charge a maximum interest rate of 4% per 30 days.
- Repayment Period: Loans are available for 30, 60, or 90 days. Extensions beyond 90 days can be arranged through prior discussion.
- Extension Options: Loan terms may be extended beyond the initial period if mutually agreed upon before the end of the term.
Fees and Charges:
- Setup, Storage, Appraisal, and Authentication Fee: A non-refundable fee of $300 per watch is charged to cover setup, storage, appraisal, and authentication.
- No Additional Fees: There are no storage fees or late payment fees.
Compliance and Legal Requirements:
- Registration: We are a registered pawnbroker under the Second-Hand Dealers and Pawnbrokers Act 1989.
- Consumer Rights: Customers are entitled to their rights under the Australian Consumer Law, including the right to dispute and recover pawned items.
Insurance and Liability:
- Insurance: Your watch is insured against theft or damage while in our possession, up to the assessed value.
- Liability Limitation: We are not liable for losses exceeding the insured value.
Dispute Resolution:
- Process: Disputes will be handled first through internal mediation. If unresolved, the matter may proceed to arbitration under the rules of Victoria.

Privacy and Data Protection:
- Data Handling: Personal information collected is used solely for processing the transaction and is protected under our privacy policy.
- Consent: By pawning your watch, you consent to our use of your data as outlined.

- Jurisdiction: These terms are governed by the laws of Victoria, and any disputes will be resolved under its jurisdiction.
Limitation of Liability:
- BuyYourWatch.com.au will not be liable for any losses or damages arising from the sale of watch(es), including but not limited to loss during shipment or discrepancies in valuation.
Disputes:
- Any disputes related to the selling process or valuation offer will be resolved through negotiation. If resolution cannot be achieved, disputes will be settled in accordance with Australian law.
Amendment:
- We reserve the right to modify these terms and conditions at any time. Continued use of our platform after such changes constitutes agreement to the new terms.
